1. Acceptance of Terms

By accessing and using GPUVolt's services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services. These Terms of Service are governed by the laws of India.

2. Service Description

GPUVolt provides cloud-based GPU computing services, including but not limited to GPU instance provisioning, storage, networking, and related infrastructure services. Our services are designed for machine learning, AI development, scientific computing, and other GPU-intensive workloads.

3. Account Registration

To use our services, you must:

  • • Provide accurate and complete registration information
  • • Maintain the confidentiality of your account credentials
  • • Be at least 18 years old or have parental/guardian consent
  • • Accept responsibility for all activities conducted under your account
  • • Notify us immediately of any unauthorised use of your account

4. Billing and Payment

4.1 Billing Accuracy

Billing begins when your GPU instance reaches the RUNNING state and ends when the instance is terminated. You are never charged during provisioning or deallocation periods.

4.2 Payment Terms

GPUVolt operates on a prepaid wallet model. You must maintain a sufficient wallet balance to use GPU services. We accept major credit/debit cards and other payment methods as listed on our platform. All prices are displayed in United States Dollars (USD) unless stated otherwise. Taxes applicable under Indian law (GST) will be added where required.

5. Refund Policy

GPUVolt offers refunds in accordance with applicable Indian consumer protection laws, including the Consumer Protection Act, 2019. The following terms apply:

5.1 Eligible Refunds

  • Service Outages: Credits or refunds for verified downtime caused by GPUVolt infrastructure failures that exceed our SLA thresholds.
  • Billing Errors: Any amount charged in error due to a platform defect will be fully refunded.
  • Unused Wallet Balance: Prepaid wallet credits that remain unused may be refunded upon account closure, subject to a processing fee of up to 5% or ₹500, whichever is lower.

5.2 Non-Refundable Items

  • • GPU compute time that was successfully delivered and consumed
  • • Storage charges for data that was stored on our infrastructure
  • • Charges arising from user error (e.g., leaving an instance running unintentionally)

5.3 Refund Process

Refund requests must be submitted within 30 days of the relevant billing event by emailing [email protected] with your account details and a description of the issue. Approved refunds will be processed within 7–10 business days to the original payment method.

6. Cancellation Policy

You may cancel GPU instances or your account at any time. The following terms govern cancellations:

6.1 Instance Cancellation

You can terminate any running GPU pod at any time via the dashboard or API. Billing ceases immediately upon termination. No cancellation notice period is required. Any data stored in ephemeral pod storage is permanently deleted upon termination.

6.2 Account Cancellation

You may close your GPUVolt account at any time by contacting [email protected]. Upon account closure:

  • • All running instances will be immediately terminated
  • • All stored data will be permanently deleted within 30 days
  • • Any remaining wallet balance is eligible for refund per Section 5.1
  • • Outstanding charges must be settled before closure is finalised

6.3 Cancellation by GPUVolt

GPUVolt reserves the right to suspend or terminate your account for violation of these Terms, non-payment, or as required by applicable law. We will provide reasonable advance notice where circumstances permit, except in cases of security emergencies or legal obligations.

7. Acceptable Use

You agree not to use our services for:

  • • Illegal activities or violation of any applicable laws or regulations
  • • Unauthorised cryptocurrency mining (unless explicitly permitted in writing)
  • • Distributing malware, ransomware, or conducting cyber attacks
  • • Violating intellectual property rights of any third party
  • • Generating excessive load that adversely impacts other users
  • • Storing, processing, or transmitting illegal content
  • • Attempting to breach security controls or gain unauthorised access

8. Service Level Agreement

8.1 Uptime Commitment

We strive to maintain 99.9% monthly uptime for our GPU services. Service credits may be provided for verified outages exceeding acceptable thresholds.

8.2 Performance Guarantees

GPU instances are expected to meet the performance specifications published on our platform. We provide monitoring and may issue automatic credits for verified performance degradation.

9. Data and Privacy

Regarding your data:

  • • You retain all rights to your data, code, and models
  • • We do not access or inspect your data without your explicit consent
  • • You are solely responsible for data backup and security within your pods
  • • We may access data only for technical support with your permission
  • • Data is deleted upon account termination or upon your written request

10. Intellectual Property

GPUVolt retains all rights to our platform, software, and infrastructure. You retain all rights to your code, data, and models. Our platform may not be reverse engineered, copied, or redistributed without prior written consent.

11. Limitation of Liability

To the maximum extent permitted by applicable Indian law, GPUVolt's aggregate liability is limited to the total amount paid for services in the 12 months preceding the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages. Nothing in these terms excludes or limits liability that cannot be excluded under applicable law.

12. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated via email or service notifications with at least 14 days' notice. Continued use of our services after the effective date of the modified Terms constitutes your acceptance of the changes.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
